Minutes for February 2, 2016

The regular monthly meeting of Yoe Borough Council was held on February 2, 2016 at the Yoe Borough Municipal Building, 150 N. Maple Street, Yoe, PA. 17313. The meeting was called to order at 7: 04 PM by President Sam Snyder followed by the Pledge of Allegiance.

Open Council Seat from January 2016 meeting
Councilman Snyder said we had an open council seat from last month since Mr. Harper was unable to take the oath of office at that time. Mr. Harper were you able to satisfy the requirements for oath of office prior to the deadline? Councilman Harper said yes. Councilman Snyder said let the record reflect that Mr. Harper was able to meet the requirements of the oath of office for councilman, therefore I declare that the council seat is not vacant and is filled. With full compliment here tonight.

Councilman Snyder asked if there are any corrections or additions to the minutes? Councilman Noll made a motion to accept the minutes of January 4, 2016 as presented. The motion was seconded by Councilman Strausbaugh. All in favor. Councilman Snyder said minutes accepted.

Councilman Snyder recognized Dennis Attig. Mr. Attig said I have one question in regards to surveying, you don’t know as far as when they are going to survey that line up there? Mr. Malesker said it’s a two part thing, the cost is split between Yoe Borough and York Township. I’ve been authorized by Yoe Borough. I sent an email to Gary Milbrand from York Township and he said he would get back to me this week. I haven’t heard anything yet. As soon as he gives the okay. After the rain tomorrow, there won’t be any snow left to hamper the survey. Mr. Attig said I will be selling the York Township part of the Anna Attig property. I need that survey. Mr. Malesker said once the survey is done, there will be comments on the survey. Mr. Attig said when the survey is complete then I can sell the part in York Township. As far a sewage, is that all closed off. Councilman Snyder said we do have some EDU’s. Off the top of my head, its between 25 or 30. Mr. Attig said on that property so if I decided to open that up, there are sewer EDU’s. Councilman Snyder in York Township that would be up to them. Mr. Attig said thank you.

Solicitor’s Report
Solicitor Springer said I got the code of ordinances from Blakey Yost.

Solicitor Springer said we scheduled a meeting on rail trail.

Councilman Snyder said we have two appointments for Yoe Borough Sewer Authority. I am not sure why they weren’t the same. Tana Bentzel (2/1/2021) and Karen Morton (3/1/2021). A motion was made to appoint Ms. Bentzel and Mrs. Morton for their five year terms by Councilman Myers. The motion was seconded by Councilman Strausbaugh. All in favor. Councilman Snyder said motion carried.

Councilman Snyder said we received notice that the property at 168 S. Main Street from the Sheriff’s Department that the property is going up for sheriff’s sale on February 8, 2016. The lien should be extinguished by sale. Councilman Snyder asked is there any way that we can get discharged our lien from the sale? Solicitor Springer said it depends if its free and clear. It depends if its free and clear. This property has already gone through the stages, unfortunately that would not be able to get the lien charges. See what you can do? This is a double edged sword, if you let people get away with it. If the sale process goes this far, they get away with it anyways. Discussion continued. Solicitor Springer said if you think the property is worth something, then you need to decide if its worth liening. Councilman Snyder said see where we stand.

Councilman Snyder said we were notified, after signing a contract with Allegiant Animal, sent a resignation as of 1/31/16. The question before the board, we have no animal enforcement officer. The contract we have is Mary Harris Animal Enforcement. There is negotiable fee, wears a uniform, does not carry a weapon, and has a certificate of insurance. Councilman Noll asked if we are required to have an animal enforcement officer? Councilman Snyder said I am not sure if we are required by law. This person wants a $300.00 retainer officer. Councilman Snyder said we have a wildlife enforcement officer. This is mainly for lost dogs, return to owner fee, etc. Councilman Noll asked can we use our wildlife officer, just a question. We don’t use the animal enforcement officer that much, could we ask them. Councilman Snyder said I am not sure if it is shall or may in the borough code. There is something in place with the SPCA. Councilman Snyder said can we use the retainer as part of the first $300.00 of covered work. Its silent in regards to that. Councilman Noll said check out if we are required and see if we can use the wildlife officer.

Councilman Noll said we should check, Windsor Township got letters that their flood ordinance is not complaint. They have been cut off from the flood program. There are other municipalities that are not covered. Councilman Snyder said we got the letter from FEMA. Councilman Noll said a house sold in the township and can’t get insurance, the resident tried to get insurance. The resident called and asked what was going on. Councilman Snyder said they got the same letter we did. Solicitor Springer said I’ll give Charlie a call. Councilman Snyder said we made things stringent where we could. Councilman Noll said we did some minor things. The other thing they may have done, they didn’t make a separate flood ordinance. We made a separate stand alone ordinance, we may be okay. Councilman Snyder said we got a letter that said we are compliant.

Councilman Snyder said Keystate Publishes, Mr. Rotz passed away unexpectedly. They are shutting down the business. They were contacted, as long as she got the go ahead from council, she would finished up what was sent in to keep us codified. 2016 forward, probably going to have to find a new codifier. Solicitor Springer asked if the borough’s association endorses anyone? Councilman Snyder said the links to the website will go away.

Engineer’s Report
Mr. Malesker said we covered the survey.

Mr. Malesker said I did share with the surveyor everything we have. Councilman Snyder updated the council on the Attig property and if its sold.

Mr. Malesker said we got the letters from DEP, about the dam basin report. That the borough did the maintenance noted on the report. I don’t know if you got the rip rap in. Next December there will be a lot less items.

Councilman Snyder said reminder anything from Jake on this grant. Mr. Malesker said we reminded him when it was due. His mother passed away. I heard he was going to be out for awhile. That was one reason he wasn’t responding, his mother was in critical care. He should be back soon. Mr. Shearer said we got notification that Mr. Romig’s company certificate of insurance was cancelled.

Councilman Snyder said the annual invoices from York Township and Dallastown paid the 2015 costs for the dam. I appreciate the cooperation.

Councilman Noll said York Conservation District is now the enforcement agency and required to inspect farms. I don’t know if they will have the ability to enforce fines. It’s not going to be voluntary compliance. Mr. Malesker said they had the ability several years ago, the ability to fine. On the municipal level, several years ago. What they have to do. Councilman Snyder said they said they have 246 to do. Councilman Noll said they have the ability to decide to fine or not.

Maintenance Report
Mr. Shearer said I have another load of salt ordered, that will bring us up to the 60% requirement.

Mr. Shearer said we have to send in our request for next winter. The past winters it raised our 60% by one load. The first couple of years was around 60 tons. That only gave us 140 max. We are at 196 max. That is give and take where we were at the past few years. A motion was made by Councilman Noll to file with co stars of 140 tons of salt for next winter season. The motion was seconded by Councilman Harper. All in favor.

Mr. Shearer said we got the tax list, so the property rental letters will go out.

Mr. Shearer said the fire hydrant should be repaired the beginning of March.

Mr. Shearer said as far as vehicle maintenance and repairs. We had some issues with the old truck as far as the transmission, it took a beating. Cherry Alley, the snow was such so much. It overworked the truck. What I want to do, take to the garage on Friday. Take a look at the transmission. Give us an idea if it’s something that needs fixed. That truck is 21 years old now. We did have Mr. Strobeck’s truck. He does want to retire from plowing snow. Getting commitments for big trucks will be hard for us. I’d like to sit down, so we can make plans in purchasing a bigger dump truck. Discussion continued. Councilman Snyder said DELLCO takes care of all Comcast, all across the United States. He said anytime you need anything in this borough, just contact me. Maybe it’s time, to say, what equipment do you have. Discussion continued. Councilman Snyder said it’s an option.

Mr. Shearer said get some prices on body panels for the newer truck.

Mr. Shearer said per request of the mayor, get some rain spouts out front. We have holes from the previous rain spouts. The one outback has taken a beating also. Councilman Noll said he would check into that. The mayor witnessed what I do for storm cleanup. Mayor Sanford said are there any alternative. Councilman Noll said there is a snow rail, that works a lot better. Councilman Noll suggested someone to Mayor Sanford to put up the gutters.

Mr. Shearer said the leaf loader, Dallastown asked we pick it up. So its near the salt shed. Councilman Noll asked if its of value? Mr. Shearer said it does work, its labor intensive. The best thing is to sell it. Mr. Shearer said I don’t remember if there is a license. Councilman Snyder said to check if there is a title. I think we have to put out for sealed bid. Mr. Shearer said if the value is over one thousand, then you have to advertise. Councilman Myers said the price has to be in writing. Councilman Myers said Brooke Shoffner buys equipment. Mr. Shearer said he is interested in the Ventrac. Councilman Myers said if its titled or licensed? If its not licensed then we don’t have a problem.

Mr. Shearer said Councilman Strausbaugh and I met with Met Ed on LED. All forty six lights will be eligible in December. The cobra head light at the traffic signal is borough owned. Met Ed won’t make recommendations. Councilman Noll said we met with Met Ed, said a minimum of 12, a maximum of 24 can be done. Mr. Shearer said we can tell them all 46, they can do 12 or 24, then come back and do the rest. Councilman Noll said the problem is figuring out the equivalency.

Mr. Shearer thanks his help for the Jonas Storm, to Mr. Sanford, Mr. Stem, Mr. Henry and Mr. Searle. We had someone on the street from the time the storm started until it ended. I only had one phone call.

Zoning Officer’s Report
Councilman Noll said I’ll pass this around. Mrs. Myers had one hearing and she also toured the borough. Code Administrator’s issued one permit.

Emergency Management Report
Mayor Sanford said I talked to Sam about extending time for people to shovel their sidewalks. Mrs. Myers didn’t go out until this past Friday to file citations. She would automatically file citations. She didn’t do anything with garbage. The garbage situation was confusing.

Mayor Sanford said I issued a storm emergency on January 21, 2016 from noon on Friday until noon on Sunday. I issued an emergency declaration of disaster. I do have a draft copy. I need a formalized copy. A motion was made by Councilman Snyder to formally adopt a declaration of emergency of disaster for Winter Storm Jonas. The motion was seconded by Councilman Strausbaugh. All in favor. Mayor Sanford said hopefully we will get funding from the federal government.

Mayor’s Report
Mayor Sanford said under police business, I received a phone call from Lt. Zech on a break in on Wilson Court. Councilman Noll said its in the area of the house, the next house up and the trailer. It is near where the Orth’s live. They went back of the house, they messed up the door. This happened about two and half weeks ago.

Mayor Sanford passed out the report from January.

Mayor Sanford said the police report for December and the year-end report for 2015.

Mayor Sanford said in the last report, there is conversation of merging, Spring Garden and Southern are part of it.

Councilman Harper said police were investigating speeding on Broad Street.

Councilman Snyder said the secretary is off for surgery. I’ll be doing that job off and on.

Councilman Snyder said the auditors are coming in on Friday.

Councilman Snyder said a letter was sent out for the $77.00 contribution to the Yoe Adamsville charge for the war memorial.

Councilman Snyder said it’s the council’s duty to review the financial reports sent in the packet.

Councilman Snyder said Yoe Borough Sewer Authority’s financial statement is part of the circulate for 2015.

Councilman Snyder said a copy of the uncollected taxes for 2015. A motion was made by Councilman Myers to accept the 2015 uncollected taxes. The motion was seconded by Councilman Harper. All in favor.

Unfinished Business
There was no unfinished business.

New Business
Councilman Noll said Met Ed will be starting to install smart meters. We will be getting more information. They will be able to read everything remotely.

Payment of Bills
Councilman Snyder said its short due to it being very early. A motion was made by Councilman Harper to accept the bills. The motion was seconded by Councilman Myers. All in favor.

A motion was made by Councilman Bankoske to adjourn at 8:52PM. The motion was seconded by Councilman Snyder. All in favor.
